In one particular case featured on Court TV, I represented a client who had already been convicted of 1st degree murder. During his trial phase to determine guilt of innocence, this client insisted on representing himself (pro se). As a result, he was found guilty of 1st degree murder. I was hired to defend him during the penalty phase of the trial. The client was facing the death penalty as a result of this conviction.

I introduced crucial evidence as to the mental state of the convicted client that ultimately led to receiving a life sentence rather than the death penalty. In the penalty phase of a 1st degree murder case, there are only two choices: a life sentence or execution.

In a recent case, my client was charged with attempted robbery. He was facing a life sentence because of his past convictions. Two undercover police officers testified in court that they saw the client approach their SUV with a gun in his hand. According to the police, they had previously heard gunfire and proceeded to investigate the origins of the shots. As the client approaches, he supposedly said to the undercover policemen, “What you got?” The police officers interpreted that as an attempt to rob them. The client sees the officers had already drawn their guns and he runs away, fearing for his life. When the police give chase, he’s arrested for felony possession of a firearm. A conviction would mean life in prison. I re-created what actually happened and showed the jury that the police had no way of knowing if his client actually was in possession of a gun. Furthermore, I successfully convinced the jury that his client’s words “what you got” was not an attempt to rob at all. The jury found for the defendant and the client was acquitted.
